1. Acceptance of Terms

Welcome to De MG Consulting LLC ("De MG Consulting," "De MG Solutions," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website located at https://www.demgsolutions.com (the "Website"), our client portal, and all services provided by De MG Consulting, including but not limited to Starter Marketing Hub services, Starter Marketing + Store Hub services, Photographer Hub services, DIY Setup services, optional Add-on Growth Tools, support and maintenance services, and related consulting services (collectively, the "Services").

By accessing or using our Website or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Website or Services.

2. Description of Services

De MG Consulting provides website and business platform services designed for self-employed and creative professionals. Our Services include Starter plans, Photographer Hub, DIY Setup, and optional Add-on Growth Tools.

2.1 Core Service Plans

We offer foundational plans to launch quickly, operate from one place, and scale as your business grows:

Starter Marketing Hub ($25/month or $250/year)

  • Professional business domain and fast, mobile-responsive website design
  • Technical SEO foundation
  • Security foundation including DDoS protection, SSL, and CDN delivery
  • Rich page builder/editor with visual editor access after launch
  • Dynamic media galleries and built-in booking, contact forms, and newsletters
  • Integrated cookie consent, Terms & Conditions page, and Privacy page
  • Centralized admin dashboard, integrated support hub, and Basic Support & Maintenance
  • Annual billing option is available at $250/year (effective $20.83/month)

Starter Marketing + Store Hub ($40/month or $400/year)

  • Everything included in Starter Marketing Hub, plus advanced e-commerce capabilities
  • Advanced product catalogs and end-to-end order management
  • Automated transaction emails and automated inventory tracking
  • Printful product and fulfillment automation
  • Secure Stripe checkout integration with Stripe partial and full refund workflows
  • Custom Stripe promo code support
  • Annual billing option is available at $400/year (effective $33.33/month)

Photographer Hub ($50/month or $500/year)

  • Everything included in Starter Marketing Hub, plus photography-specific workflow tools
  • Client photo delivery automation, quotes, invoicing, and organized feedback workflows
  • Annual billing option is available at $500/year (effective $41.67/month)

DIY Setup

  • Website platform setup for clients who want to load their own content and manage launch independently
  • New domain registration, DNS setup, website platform access, and knowledge documents are included
  • Existing domain transfers, registrar migrations, and existing DNS/email migrations require a Done-for-You Setup or separately scoped service
  • Typical turnaround is 1-2 business days after payment and domain purchase
  • No done-for-you design, launch walkthrough, migration support, or ongoing management unless separately stated in writing
  • May be upgraded later into a managed Starter plan, Photographer Hub plan, or support scope based on remaining work

2.2 Service Terms

  • Transparent Pricing: All costs are disclosed in the applicable quote, checkout, proposal, or service agreement before service activation
  • Starter Set-up Fee: The standard Starter plan set-up fee is $199; an ongoing $50 Launch Discount reduces the current Starter set-up fee to $149, billed only after your final demo approval
  • No Upfront Billing: We build first and begin billing only after you approve the demo and request launch
  • DIY Setup Scope: DIY Setup services are limited to the selected website platform package, new domain registration/DNS setup, access, and knowledge documents expressly listed in your proposal or service agreement. Existing domain transfers require a Done-for-You Setup or separately scoped service
  • Scalable Structure: You may begin with a Starter plan and add optional services as business needs evolve
  • Third-Party Dependencies: Certain features may require third-party tools or providers with separate terms and fees

2.3 Optional Add-on Growth Tools

  • Blog Functionality ($5/month): Adds blog publishing functionality to supported websites. Blog content writing, SEO strategy, post formatting, and recurring posting are separate services unless expressly included in your quote.
  • Expanded CMS Storage ($19/month): Provides expanded standard CMS capacity for normal website content. This does not include unlimited media libraries, client photo delivery galleries, Cloudflare R2 gallery storage, vendor overage charges, or unusually heavy asset usage.
  • Email Pro ($29/month): Provides higher-volume email sending through the supported email provider plan, currently including up to 50,000 emails per month unless otherwise stated in your quote.
  • Platform Cleanup ($49/request): A per-request review and cleanup pass for CMS document, asset, or content-organization limits. Cleanup depends on what can be safely archived, consolidated, or removed without harming the website.
  • New Page Build (from $49/page): Starts at $49 per page for one simple CMS-backed page using an existing layout or section pattern. More involved pages, landing pages, custom layouts, forms, copywriting, SEO research, ecommerce flows, or integrations require a separate quote.
  • Priority Website Management ($75/month): Includes up to 5 simple content updates or 2 hours of website content updates per month, whichever comes first. Unused updates and unused time do not roll over.
  • Managed add-ons are subject to availability, account eligibility, third-party provider limits, and the scope stated on the Scale with Us page, quote, invoice, or written agreement.

3. Accounts and Service Access

3.1 Account Registration

To access certain Services, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use our Services. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Payment Terms

4.1 Fees and Billing

  • Subscription Fees: Monthly subscription fees are based on selected services and start at:
    • Starter Marketing Hub: $25/month or $250/year (effective $20.83/month)
    • Starter Marketing + Store Hub: $40/month or $400/year (effective $33.33/month)
    • Photographer Hub: $50/month or $500/year (effective $41.67/month)
  • Starter Set-up Fee: The standard Starter set-up fee is $199; an ongoing $50 Launch Discount reduces the current Starter set-up fee to $149, billed only after final demo approval
  • DIY Setup Fees: DIY Setup is billed through the selected website platform subscription unless a separate one-time fee is expressly stated in writing
  • Managed Add-ons: Current add-ons may include Blog Functionality ($5/month), Expanded CMS Storage ($19/month), Email Pro ($29/month), Platform Cleanup ($49/request), New Page Build (from $49/page), and Priority Website Management ($75/month). Prices may change for new requests, custom scopes, provider cost changes, or unusually high usage.
  • No Upfront Billing: We build your solution first and only begin billing after you approve the demo, confirm it is production ready, and request to start your service
  • All fees are in US dollars
  • Payment is due upon receipt of invoice
  • All subscription and service payments are securely processed via Stripe
  • Billing administrators may manage billing within the De MG Solutions Support Section where applicable

4.2 Bundle Discounts

Clients who combine multiple services may be eligible for bundle discounts. Specific discount rates will be provided in the applicable quote, proposal, or service agreement.

4.3 Billing Cycle

  • Monthly subscription fees are billed in advance on a recurring monthly basis
  • Annual subscription fees are billed in advance on a recurring yearly basis
  • Monthly plans automatically renew each month unless canceled at least 48 hours before the renewal date
  • Annual plans automatically renew each year unless canceled or changed at least 48 hours before the renewal date
  • You may request cancellation or service changes at any time through the De MG Solutions Support Section or by contacting us at [email protected]

4.4 Refunds

  • Monthly and annual subscription fees are non-refundable except as required by law
  • Annual pricing is billed at a discounted rate in exchange for a full-year commitment and is non-refundable once charged, except as required by law
  • The first website platform subscription charge and domain costs are non-refundable once provisioning or domain purchase begins, except if De MG Solutions cannot deliver the setup or as otherwise required by law
  • Custom project fees may be partially refundable based on work completed, as determined on a case-by-case basis
  • No refunds will be issued for Services already rendered

4.5 Late Payments

If payment is not received within 10 days of the due date, we reserve the right to suspend access to Services until payment is received.

4.6 Existing Partner Benefits

Existing partners adding new services can access preferred pricing and expedited onboarding.

4.7 Annual Renewal & Price Lock

The Total Monthly Recurring Fee (inclusive of the base subscription and any active add-on services) is guaranteed and locked for a period of 12 months from the start of service.

Upon the anniversary of this agreement, these recurring fees are subject to an annual adjustment commensurate with the prevailing rate of inflation and operational costs. We guarantee that your recurring rates will never increase more than once per year, and you will receive 30 days' written notice of any change.

4.8 Taxes and Merchant Responsibility

You are solely responsible for determining, calculating, collecting, reporting, and remitting any sales, use, value-added, excise, or other applicable taxes arising from transactions processed through your online store, invoices, payment links, client photo delivery workflows, or any other client-facing payment or checkout experience connected to your business.

This responsibility applies even where payment processing is facilitated through a Stripe account connected through, configured by, or otherwise supported by De MG Solutions. De MG Solutions does not assume, and expressly disclaims, any obligation to calculate, collect, report, or remit taxes on your behalf unless expressly agreed in writing.

5. Intellectual Property Rights

5.1 Our Intellectual Property

All content on our Website and within our Services, including but not limited to text, graphics, logos, images, audio, video, software, AI models, and compilation of content, is the property of De MG Consulting or our licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 Client Intellectual Property

You retain all rights to content and materials you provide to us for the purpose of receiving Services ("Client Content"). You grant us a limited, non-exclusive license to use Client Content solely for the purpose of providing Services to you.

5.3 Deliverables

Unless otherwise agreed in writing:

  • Custom websites and progressive web applications (PWAs) developed for you become your property after you have made at least $1,500 in cumulative payments toward the applicable build and service engagement
  • Transfer of ownership, upon termination of services, does not include hosting services; you will be responsible for securing your own hosting provider
  • De MG Consulting will provide reasonable assistance (up to 2 hours) to facilitate migration to your chosen hosting provider
  • Clients who discontinue service before reaching $1,500 in cumulative payments forfeit custom website and progressive web application ownership rights to all developed materials
  • We retain the right to use generic components, methodologies, and know-how developed during the engagement
  • We may showcase completed work in our portfolio with your permission

6. Use Restrictions

You agree not to:

  • Use our Services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of our Services
  • Use our Services to compete with us or build a similar service
  • Resell or redistribute our Services without written permission
  • Use automated systems to access our Services without permission
  • Harass, abuse, or harm other users or our staff

7. Confidentiality

7.1 Confidential Information

Both parties may have access to confidential information during the course of the relationship. Each party agrees to:

  • Keep all confidential information strictly confidential
  • Use confidential information only for purposes of the Services
  • Not disclose confidential information to third parties without written consent

7.2 Exceptions

Confidentiality obligations do not apply to information that:

  • Was publicly known at the time of disclosure
  • Becomes publicly known through no fault of the receiving party
  • Was rightfully received from a third party
  • Is required to be disclosed by law

8. Data Protection and Privacy

8.1 Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Data Security

We implement industry-standard security measures to protect your data, including:

  • SSL encryption for data transmission
  • Secure cloud hosting infrastructure
  • Regular security updates and monitoring
  • Limited access controls

8.3 Data Processing

For clients whose data we process as part of our Services, we act as a data processor and will handle data in accordance with applicable data protection laws.

8.4 Accessibility, WCAG, and Compliance Responsibilities

We design and configure supported website platforms with accessibility-minded practices, including semantic structure, headings, keyboard-aware interactions, descriptive labels where applicable, responsive layouts, and support for common accessibility practices. We may reference WCAG, ADA, Section 508, AODA, EAA, or similar standards as design and quality guidance.

You understand and agree that laws, regulations, technical standards, court interpretations, agency guidance, third-party tools, and your own website content may change over time. We do not provide legal advice and do not guarantee that your website, content, business, or digital operations will be fully compliant with WCAG, ADA, Section 508, AODA, EAA, or any other accessibility law or standard at all times.

  • You are responsible for the accessibility and legal compliance of your own business, website content, images, videos, PDFs, documents, third-party embeds, plugins, forms, products, copy, color changes, media uploads, external links, legal notices, and post-launch edits.
  • You are responsible for adding and maintaining accurate alt text, captions, transcripts, accessible file formats, clear labels, descriptive links, and other accessibility-supporting content when you or your team add or edit website content.
  • Third-party services, widgets, payment tools, scheduling tools, maps, social embeds, analytics tools, ecommerce providers, email providers, fonts, media players, and other integrations may introduce accessibility issues outside our control.
  • Automated accessibility scans, Lighthouse reports, axe checks, overlays, or similar tools are not legal certifications and do not guarantee that a website is free from accessibility barriers.
  • If you need a formal accessibility audit, remediation project, VPAT, legal review, compliance certification, or ongoing accessibility monitoring, those services must be scoped separately and may require qualified accessibility specialists or legal counsel.

9. Warranties and Disclaimers

9.1 Our Warranties

We warrant that:

  • Services will be performed in a professional and workmanlike manner
  • We have the right to provide the Services
  • Services will substantially conform to specifications agreed upon in writing

9.2 Disclaimers

EXCEPT AS EXPRESSLY PROVIDED HEREIN, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT:

  • SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
  • DEFECTS WILL BE CORRECTED
  • OUR SERVICES OR SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS
  • RESULTS FROM SERVICES WILL MEET YOUR EXPECTATIONS

9.3 Third-Party Services

We may recommend or integrate third-party services (such as Zapier, ActiveCampaign, QuickBooks, etc.). We are not responsible for the availability, accuracy, or content of third-party services.

9.4 Accessibility Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES THAT THE WEBSITE, PLATFORM, SERVICES, CLIENT CONTENT, THIRD-PARTY SERVICES, OR POST-LAUNCH MODIFICATIONS WILL SATISFY ANY SPECIFIC ACCESSIBILITY LAW, WCAG CONFORMANCE LEVEL, AGENCY GUIDANCE, COURT STANDARD, OR REGULATORY REQUIREMENT UNLESS THAT SPECIFIC WARRANTY IS EXPRESSLY STATED IN A SIGNED WRITTEN AGREEMENT.

10. Limitation of Liability

10.1 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DE MG CONSULTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

10.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

10.4 Accessibility Claims and Lawsuits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DE MG CONSULTING SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DEMAND LETTER, CLAIM, INVESTIGATION, ADMINISTRATIVE PROCEEDING, LAWSUIT, SETTLEMENT, PENALTY, FINE, ATTORNEYS' FEES, REMEDIATION COST, BUSINESS INTERRUPTION, OR OTHER LOSS ARISING FROM OR RELATED TO WEBSITE ACCESSIBILITY, WCAG, ADA, SECTION 508, AODA, EAA, OR SIMILAR ACCESSIBILITY REQUIREMENTS, EXCEPT TO THE LIMITED EXTENT SUCH LIABILITY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

You remain responsible for responding to any accessibility complaint, demand, claim, audit request, regulatory inquiry, or lawsuit involving your business, website, services, customers, or content. We may, at our discretion, offer technical remediation support under a separate scope and fee, but we do not assume responsibility for legal defense, settlement, penalties, or compliance obligations unless expressly agreed in writing.

11. Indemnification

You agree to indemnify, defend, and hold harmless De MG Consulting, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Client Content
  • Your website or business legal documents, including your Terms and Conditions, Privacy Policy, cookie notices, and related disclosures
  • Any claim, regulatory inquiry, penalty, or lawsuit arising from your data collection, consent practices, marketing practices, or legal/compliance obligations
  • Any claim, regulatory inquiry, penalty, lawsuit, demand letter, or remediation obligation arising from your accessibility obligations, WCAG/ADA/Section 508/AODA/EAA compliance, or similar legal/compliance obligations
  • Any accessibility issue caused or contributed to by content, media, files, third-party integrations, design changes, color changes, copy changes, post-launch edits, or instructions provided by you or your team

12. Termination

12.1 Termination by You

You may terminate your account and services at any time by:

  • Submitting a cancellation request through the De MG Solutions Support Section
  • Sending written notice to [email protected]
  • Contacting us via phone or chat support

12.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You fail to pay fees when due
  • We reasonably believe termination is necessary to protect us or other users
  • Required by law

12.3 Effect of Termination

Upon termination:

  • Your right to use our Services immediately ceases
  • All fees owed become immediately due and payable
  • We may delete your account and data after 30 days
  • If termination occurs before $1,500 in cumulative payments toward the applicable build and service engagement, all custom websites and progressive web applications remain the property of De MG Consulting and access will be terminated
  • If termination occurs after you have reached $1,500 in cumulative payments toward the applicable build and service engagement, you retain ownership of custom websites and PWAs but must arrange for alternative hosting within 30 days
  • Provisions that should survive termination will remain in effect

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal proceedings, you agree to attempt to resolve disputes informally by contacting us at [email protected].

13.2 Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. Arbitration shall take place in New York, New York.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to bring or participate in any class action or representative proceeding.

13.4 Exceptions

Notwithstanding the above, either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

14.2 Entire Agreement

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and De MG Consulting.

14.3 Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our Services. Continued use after changes constitutes acceptance.

14.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14.5 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to any successor or affiliate.

14.6 No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

14.7 Force Majeure

Neither party shall be liable for delays or failures in performance due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, labor disputes, or internet service failures.

14.8 Notices

14.9 Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations in your use of our Services.

14.10 Accessibility Feedback

We welcome accessibility feedback about our own Website and Services. If you have accessibility needs or encounter an issue with a De MG Solutions-controlled page, please contact us at [email protected]. Client-owned content, third-party tools, and post-launch edits remain subject to the responsibilities described in Section 8.4.

15. Service-Specific Terms

15.1 Starter Marketing Hub Services

  • Starter Marketing Hub includes the core website and operations foundation described in your active service agreement and plan scope
  • Starter Marketing Hub includes visual editor access so your team can update approved on-site content after launch
  • Core features include marketing website functionality, booking/contact/newsletter capabilities, and centralized dashboard access, subject to your subscribed scope
  • Security and performance controls (including DDoS protection, SSL, and CDN delivery) are provided through our managed platform stack and hosting partners
  • You are responsible for providing final approved content, assets, and legal/business information unless content creation services are separately included

15.2 Starter Marketing + Store Hub Services

  • Starter Marketing + Store Hub includes everything in Starter Marketing Hub, plus e-commerce features as defined in your approved scope
  • E-commerce features may include product catalog configuration, order workflows, transaction email automations, inventory tracking, Stripe integration, and related store operations tooling
  • You are responsible for your merchant account compliance obligations, tax configurations, fulfillment policies, and product/legal disclosures
  • While De MG Solutions does not charge platform transaction fees, third-party payment processors (including Stripe and other payment rails) may charge their own processing or service fees
  • Store data accuracy (including pricing, inventory, shipping settings, and product data) is your responsibility after handoff unless covered by an active support scope

15.3 Starter Hub Usage Limits

The following included usage allowances apply to Starter Marketing Hub and Starter Marketing + Store Hub plans unless otherwise stated in a written service agreement:

  • Newsletter sending to up to 1,000 contacts
  • Up to 100 in-platform contact form responses per day
  • Up to 100 GB of bandwidth per month, which typically supports 20,000 or more monthly visitors depending on site traffic patterns and media usage
  • Up to 100 GB of media storage for hosted images, videos, and PDF files
  • Up to 10,000 total stored documents across pages, blog posts, products, and media records
  • If your usage exceeds the included limits, you may be required to upgrade your plan or purchase additional storage, bandwidth, or other capacity at our then-current rates in order to maintain uninterrupted service

15.4 Photographer Hub Services

  • Photographer Hub includes everything in Starter Marketing Hub, plus photography-specific workflow tools as defined in your approved scope
  • Included features may include client photo delivery automation, quotes, invoicing, final proof workflows, and client feedback organization
  • Unless otherwise agreed in writing, proof galleries, final image delivery files, and related Photographer Hub delivery assets may be hosted for up to 30 days after delivery, publication, or client access is made available, after which they may be removed from the active delivery workspace without further archival obligation on our part
  • Where available, proof selection records may be downloaded or exported from the Finals tab of the applicable client photo delivery document to your own device for your independent storage and historical reference, and you are responsible for maintaining any long-term copies you wish to retain
  • You are responsible for providing approved galleries, deliverables, pricing details, turnaround policies, and client-facing business information unless separately included in writing
  • Any paid third-party licenses, apps, storage, or vendor usage costs remain your responsibility unless explicitly included in writing

15.5 Add-on Growth Tools

  • Add-on Growth Tools and managed add-ons are optional services that may be billed monthly, one-time, per request, per page, or in blended models depending on implementation scope
  • Blog Functionality is a platform add-on only unless content writing or editorial services are separately quoted
  • Priority Website Management covers simple content updates only, subject to the monthly update/time cap. It does not include new page builds, redesigns, custom development, ecommerce setup, SEO strategy, blog writing, emergency support, or large media/gallery uploads unless separately quoted
  • Platform Cleanup does not guarantee that storage limits can be reduced or avoided. Some limits may require a vendor plan upgrade, quota increase, or custom cleanup project
  • Expanded CMS Storage and Email Pro depend on third-party vendor plans and limits. Provider overages, plan changes, deliverability issues, contact-list compliance, high-volume media, gallery storage, and custom quota needs may require separate charges
  • New Page Build pricing starts at $49/page for simple pages using existing layouts. More complex page work is quoted separately
  • Add-on availability and performance may depend on third-party platforms, APIs, and vendor terms that are outside our control
  • Any implementation requiring paid third-party licenses, platform subscriptions, or vendor usage costs remains your responsibility unless explicitly included in writing

15.6 DIY Setup Services

  • DIY Setup services are limited to the selected website platform package, new domain registration, DNS setup, platform access, and knowledge documents expressly listed in your proposal or invoice
  • New domain registrations are subject to availability, registrar eligibility, and successful purchase. Existing domain transfers, registrar ownership transfers, DNS migrations, email-record migrations, and related troubleshooting are not included in DIY Setup and require a Done-for-You Setup or separately scoped paid service
  • The first website platform subscription charge and domain costs are non-refundable once provisioning or domain purchase begins, except if De MG Solutions cannot deliver the setup
  • Unless expressly included in writing, DIY Setup services do not include done-for-you design, content entry, launch management, data migration, testing, custom integrations, SEO implementation, or legal/compliance review
  • You are responsible for entering your own content, configuring your own tools, reviewing all pages and flows, and deciding when or whether to launch
  • You are responsible for verifying compatibility with any third-party apps, plugins, payment tools, or vendors you choose to connect unless we separately agree to implement and test them
  • If you later request implementation, launch help, or platform management, that work will be scoped and billed separately under a managed service or support agreement

15.7 Support Services (Basic and Priority)

  • Basic Support & Maintenance covers platform updates/security, minor content updates, bug fixes/troubleshooting, and platform Q&A guidance
  • Priority Support or Priority Website Management add-ons include everything in Basic Support plus the simple content-update scope stated in your quote, invoice, Scale with Us page, or service agreement. New page creation, major redesign requests, catalog overhauls, and advanced custom work require separate scope approval unless expressly included in writing
  • Support response times and delivery timelines vary based on request complexity, queue volume, and whether required assets/approvals are provided
  • Requests outside active scope may require a separate statement of work, timeline, and fee approval before implementation begins

15.8 Legal Compliance and Policy Documents

  • De MG Solutions does not provide legal advice and does not represent or warrant that any website legal text, templates, or policy language is compliant with applicable laws in your jurisdiction
  • You are solely responsible for the legal sufficiency, accuracy, and ongoing compliance of your Terms and Conditions, Privacy Policy, cookie notices, disclaimers, and consent language
  • You are responsible for obtaining independent legal counsel to review and approve your legal documents and compliance practices before and after launch
  • Claims, disputes, fines, or lawsuits related to your legal documents or compliance obligations remain your responsibility, subject to the indemnification obligations in Section 11

16. Community Guidelines

We maintain community spaces within our client portal to foster collaboration and knowledge sharing. Users agree to:

  • Treat all community members with respect
  • Not engage in discrimination or harassment
  • Share knowledge and resources constructively
  • Respect intellectual property and confidentiality of shared information
  • Report inappropriate behavior to our moderation team
